Availability and prices and are immediately subject to change without any notice. Any and all errors are corrected when and where found, and Gibraltar Furniture maintains the right to cancel and/or replace any stated offer and maintains the right to correct any and all omissions, errors, and inaccuracies even after an sales order is submitted, whether the order is confirmed and/or your debit or credit or card is charged or not. If your debit/credit card is already charged for purchase and you cancel the order, Gibraltar Furniture issues credit to the account holder of the credit card that is in the same amount of the purchase charge. Policies of each Individual bank will determine when the amount will be credited to credit or debit card account.
2. Limitation of Liability and Disclaimers
The Gibraltar Furniture website is offered in an "AS IS," and "as available" manner. 4. Quantities Can be Limited
Gibraltar Furniture can, at its discretion, cancel or limit or quantities for purchase by an individual person, household or order. These restrictions can include any and all orders placed on the same account, credit/debit card. They also apply to orders using the exact same shipping and/or billing address. Notification is sent to the billing and/or e-mail address if such change occurs. Gibraltar Furniture reserves the right to limit any quantities sold, this includes our right to prohibit or limit dealer sales.
5. Applicable Laws
The Gibraltar Furniture website is created, controlled, and operated by Gibraltar Furniture, Inc. in the California state, United States of America. The laws of California State govern the Terms of Service without offering any effect to principles or any conflict of laws. We maintain the exclusive rights to make any changes to the Gibraltar Furniture™ site and the right to modify and or change the Terms of Service any time via an update of this posting. By using the Gibraltar Furniture website, you agree that you are bound by any and all revisions. 6. Freight
Gibraltar Furniture is not a freight company, and not a delivery company. Our third party freight carriers do not provide inside residential services due to insurance regulations.
We provide connections to these outside third party vendors and we do not take responsibility for their performances. We include this notice on our website, invoice, and all the e-mails we send.
7. Re-Stocking Fees
All orders are subject to a 20% re-stocking fee if canceled.
8. Agreement for Service
The Terms of Service are the entire agreement between Gibraltar Furniture and you with regards to your relationship with Gibraltar Furniture and they supercede any and all prior representations or statements. By using this Gibraltar Furniture website YOU AGREE TO THESE TERMS OF SERVICE. If you are not satisfied with the web site or any and all content of the Gibraltar Furniture website or any and all of with the Terms of Service, we suggest that you stop using the website as your exclusive and sole remedy.

10. Sales Contract
GIBRALTAR FURNITURE TERMS & CONDITIONS
DELIVERY
We pass on our wholesale shipping rate directly to our customers. This is a 65%, or more discount rate. Each unit is specially packed, and cushioned to insure that your furniture arrives in perfect shape. This service adds a few extra days but is worth it. If your delivery is delayed it is a function of the delivery service and we will do everything in our power to speed the process. Please note if your item is a custom special order. If you order is a custom special leather order item, that is not in stock, plan on an 8-10 week wait for all orders.
RETURN POLICY
All custom special orders are not returnable.
Undamaged product, that are not special orders items, can be returned within 7 days of delivery date provided it is in mint & saleable condition and is in original carton. YOU MUST PLACE THE ORGINAL CARTON INSIDE ANOTHER BOX. All return freight costs are the sole responsibility of the consumer. Product not in original carton may not be returned for credit. All of our items are examined before we crate them to insure that 100% of the goods are mint in box. We will not send out any item that has any defect, blemish, or damage. Therefore, be advised that any damage that occurs will have happened in transit. Please uncrate and examine all goods upon receipt of your shipment. All merchandise should be fully inspected upon receipt for evidence of damage or shortage before acceptance. A 20 % re-stocking fee applies to any and all returns that are stock items. No returns are accepted without prior, written authorization
ORDER CANCELATION
Check your order for size, exactness, finish, color choice, fabric selection, and quantity accuracy. You have 48 hours to contact us to contact us and make any necessary changes before your order is finalized. Once an order has been entered in the system it is final. If the item you have selected is a custom special furniture order. it is non-cancelable and non-returnable.
FREIGHT DAMAGE
If damage or shortage occurs, promptly refuse acceptance until transportation agent endorses extent of damage or shortage. If external appearance has not indicated damage, but upon opening, contents are found damaged, unpacking should be stopped and an inspector of the delivering carrier should be called immediately. The inspector should indicate on the delivery receipt the exact condition of the contents. You must file a freight claim immediately within 24 hours. Save all packaging, wrapping, boxes, packing slips, bill of ladings, and pro numbers for submission to the freight inspector. A freight inspector will examine such and these are important parts in order to verify your loss. A freight claim does not void the order, nor will it cause delay for on time payment in full for the product shipped. Necessary re-orders in the event of severe freight damage will be handled by Gibraltar on a fast track basis. On all orders we will attempt to schedule, with the help of the freight company, the best departure schedule available. However, we cannot be responsible for truck arrivals or mistakes made by the freight company.
HIDDEN DAMAGE
DO NOT ACCEPT RECEIPT OF GOODS IF ANY HIDDEN DAMAGE IS SUSPECTED! WE CANNOT BE HELD RESPONSIBLE FOR HIDDEN DAMAGEAFTER YOU HAVE SIGNED FOR THE RECEIPT OF GOODS. Gibraltar will not ship any goods to which the shipper has attached any exception. Therefore all Goods on a shipment are shipped in new condition and complete and any claims at the receiving end are strictly between the receiver and the shipper. If a shipment is received damaged you should immediately file a claim with the transportation company. This includes any damages, hidden or otherwise, or any missing parts or hardware during the shipping and delivery process. In the event that Gibraltar pays the freight on an order no additional liability or responsibility for that order is being assumed by Gibraltar. It is the sole responsibility of the receiver to file any freight claims.
FREIGHT DAMAGE REPORTS
Reports, and damage claims for all carriers, freight operators, UPS, Fed Ex, and other shipping services is the sole responsibility of the purchaser. Receipt of this policy is your acknowledgment that you understand and agree to the above-mentioned terms and conditions. Contact Gibraltar within 24 hours re any damage. Our acceptance of an order is final and binding, and not subject to cancellation by the customer. If the customer cannot take receipt of goods on acknowledged delivery date, we reserve the right to transfer goods to storage. Cost of the transfer and storage will be charged to the purchasers account, and such transfer shall constitute shipment, including invoicing as of date of transfer and/or storage.
LATE PAYMENT FEES
By placing an order with Gibraltar the purchaser agrees to pay in full all accounts COD. Failure to comply will result in an automatic 2% late fee per month, and forfeiture of open credit. Gibraltar authorized sales representatives are not acting as agents of any factory. They empowered to present and promote the factory sales material and to take orders for its products. Any custom pricing or product verification is valid only if presented in writing by Gibraltar. All prices suggested list, F.O.B. factory, Los Angeles, Freight, crating, handling cartooning, delivery and installation costs are additional to the prices shown.
GIBRALTAR IS NOT FREIGHT COMPANY.
Gibraltar Furniture is a furniture sales company. We specifically are not a freight company, and not a delivery service. We provide connections to these outside third party vendors and we do not take responsibility for their performances. We include this notice on our website, invoices, and all the e-mails we send. Please note that some products ship to us via container via sea freight. This process sometimes can take longer due to transit, weather conditions, customs, and increased recent security concerns. Plan on 12-14 weeks for sea freight. Please let us know when you place your order if you wish to pay for additional air freight to speed your delivery. This delivery service is costly but speedy. Upon request we will be happy to add such. Kindly note that recent post 9/11 customs inspections may result in additional delays due to increased scrutiny by Federal officials holding shipments at the port for examinations. We can not control any postponements that may result as a function of such as they are beyond our control.
VITRA WARRANTY
Any and all damage, for Vitra products must be reported within 3 days of receipt. Thereafter, Vitra will not issue any refunds, credits, or exchanges. All Vitra products, except for the Vitra Goods collection, are warrantee for 5 years after their shipment against defects in workmanship and materials provided that the product is used under the condition for which it was designed for. Normal wear and tear is expressly excluded from the warranty. Veneers and laminates are not included in this warranty.
VITRA GOOD COLLECTION
Products in the Vitra goods collection, including the Morrison Collection, Panton Collection, Prouve Collection, and Noguchi Collection, which are sold as works of art, are specifically excluded from this warranty.
RETURN AUTHORIZATION
Return of furniture will not be accepted without our written authorization and shipping instructions. Unauthorized returns will be returned freight collect.
DOCK TO DOCK AND WHITE GLOVE DELIVERY SERVICES
** MOST OF OUR LARGE FURNITURE PRODUCTS CANNOT BE DELIVERED WITH "SMALL PACKAGE" SHIPPING COMPANIES, SUCH AS UPS OR FEDEX GROUND. IN MOST CASES, WE NEED TO USE "FREIGHT" COMPANIES. WE OFFER ThREE(3) TYPES OF FREIGHT SERVICE:
** MOST OF OUR LARGE FURNITURE PRODUCTS CANNOT BE DELIVERED WITH "SMALL PACKAGE" SHIPPING COMPANIES, SUCH AS UPS OR FEDEX GROUND. IN MOST CASES, WE NEED TO USE "FREIGHT" COMPANIES. WE OFFER THREE (3) TYPES OF FREIGHT SERVICE:
(1) STANDARD CURBSIDE DROP-OFF. (ONE MAN DRIVER), THIS DOCK TO DOCK SERVICE IS FAST, AND AFFORDABLE. MOST CUSTOMERS PREFER THIS METHOD. WE GENERALLY USE FEDEX FREIGHT, CONWAY, AND YELLOW FREIGHT FOR OUR DELIVERY SERVICE. WE ALSO USE BAXGLOBAL AND UPS TO SELECTED SITES. PLEASE BE PREPARED TO TAKE POSSESSION OF YOUR FURNITURE ORDER AT THE BACK OF THE TRUCK ON THE STREET AND MOVE IT INSIDE ON YOUR OWN. THE DRIVER WILL NOT TAKE THE SHIPMENT INSIDE, CARRY IT UPSTAIRS, OR ASSEMBLE THE MERCHANDISE. PLEASE ALLOW UP TO 1-2 WEEKS FOR DELIVERY AFTER SHIPMENT FROM OUR WAREHOUSE. THE COST FOR THIS SERVICE IS LISTED FOR ALL PRODUCTS UNDER SHIPPING.
(2) “INSIDE DELIVERY” (ONE MAN DRIVER) THE DELIVERY COMPANY WILL TAKE YOUR ORDER INTO YOUR LOCATION AND CARRY YOUR GOODS INSIDE YOUR PLACE. NO ASSEMBLY AND NO TRASH REMOVAL SERVICES ARE INCLUDED. EXTRA CHARGES WILL APPLY FOR STAIRS. PLEASE ALLOW UP TO 2-3 WEEKS FOR DELIVERY AFTER SHIPMENT FROM OUR WAREHOUSE. THE COST FOR THIS UPGRADE WILL RANGE FROM $150 -$250, OR MORE, DEPENDING ON YOUR LOCATION AND YOUR JOB REQUIRMENTS. THIS IS IN ADDITION TO THE STANDARD CURBSIDE DROPP-OFF RATE.
(3) "WHITE GLOVE" (TWO MAN TEAM); THIS PREMIUM SERVICE IS SLOWER AND COSTS MORE. WE WILL SET UP A SPECIALIZED DELIVERY TEAM TO INSURE A NO HASSLE FULL SERVICE JOB. THEY WILL DELIVER INSIDE YOUR HOME, UNPACK AND REMOVE PACKAGING MATERIALS. UP TO 2 FLIGHTS OF STAIRS ARE INCLUDED. UP TO 15 MINUTES OF ASSEMBLY ASSISTANCE IS INCLUDED THIS IS A POPULAR SERVICE OPTION. PLEASE ALLOW UP TO 2-4 WEEKS FOR DELIVERY AFTER SHIPMENT FROM OUR WAREHOUSE. THE COST FOR THIS UPGRADE WILL RANGE FROM $200 -$300, OR MORE, DEPENDING ON YOUR LOCATION AND YOUR JOB REQUIRMENTS. THIS IS IN ADDITION TO THE STANDARD CURBSIDE DROPP-OFF RATE.
YOU MUST SELECT WHICH DELIVERY SERVICE YOU PREFER PRIOR TO SHIPPING. IT CANNOT BE CHANGED WHILE THE ORDER IS ENROUTE.
